Generally, anyone of sound mind and at least 18 years old can create one. Typically, a “sound mind” refers to the ability to understand a document and its contents.
A living will takes effect when your state’s laws determine that you are in a severe medical condition without hope of recovery and cannot communicate your wishes. When you cannot make decisions for yourself and name someone to make medical decisions other than life support, the document automatically takes effect.
In most cases, doctors determine you have lost your ability to make decisions if you are unable to understand your treatment options or communicate your wishes.
